In John W. Stone Oil Distributor’s continuing effort to reduce our carbon footprint we have transitioned vessels in our fleet from conventional diesel to renewable diesel. In association with that we have begun offering renewable diesel to our customer base as a certificated RD99 and in various locations as a blend with ULSD. Being a direct drop in diesel, at a very modest differential in price, and with ratable volume, this was the most logical step for Stone. We believe this will be the most logical step for the maritime industry in reducing GHG emissions in a well-to-wake, or as we would like to say field-to-funnel analysis. The ease of transitioning from conventional to renewable is seamless; no operational or equipment changes, fully compatible with existing onboard diesel with none of the issues experienced with biodiesel. Availability of the fuel for domestic marine transportation is key for our distribution strategy. With our combined terminals and floating assets, we will continue to supply the conventional marine ULSD in conjunction with the renewable diesel and will continue to pursue market opportunities for all products.
Renewable RIN Retirement Assessment Addendum
- Renewable Fuels. The Product, neat or blended renewable diesel, purchased or sold pursuant to this Confirmation, is designated and intended for use as a transportation fuel, heating oil, or jet fuel EXCLUSIVELY in the 48 contiguous states of the United States and Hawaii [consistent with 40 CFR Part 80, Subpart M (“RFS”)]. If the Product is used in any manner that is a “non-qualifying fuel use” under the RFS, then Buyer assumes sole liability and ALL obligations RELATED TO compliance with applicable laws, including the retiring OF sufficient Renewable Identification Numbers (“RINs”) to comply with THE RFS.
- Exports. Any person (including Buyer or its designees) exporting renewable fuel is subject to the requirements of 40 CFR 80.1430. If the Product is not designated for export and it is later exported, then Buyer assumes sole liability and ALL obligations RELATED TO compliance with applicable laws, including the retiring OF sufficient RINs to comply with RFS.
- Indemnification. Buyer shall indemnify, defend, and hold harmless Seller from any and all damages, liabilities, penalties, fines, costs, and expenses, including reasonable attorneys’ fees, arising out of claims, suits, PENALTIES, ADMINISTRATIVE PROCEEDINGS AND/OR allegations or charges relating to Buyer’s failure to comply with the provisions of this section.
